The Elektro- und Elektronik- gerätegesetz (Electrical and Electronic Equipment Act - ElektroG) came into force on <date month="3" day="24" year="2006" w:st="on">24 March 2006</date>. Your electrical promotional items such as torches, USB flash drives, electrical fans and radios are of course affected by this.
Consumers must take electrical waste to local collection points for disposal. There are no costs associated with doing so.

Manufacturers are obliged to take back the equipment from the collection points and to safely dispose of it using the latest state of the art. This is now another area where the principle of product responsibility has been introduced and the act forces all players to fulfil their responsibilities. (www.stiftung-ear.de/e43/e150/e356/)
In order not to be forced to fulfil your responsibilities you must ensure that you only purchase equipment from registered manufacturers.
If you distribute goods from non-ElektroG registered manufactures then you would be deemed to be the manufacturer for these goods and would therefore be responsible fro their disposal. According to ZVEI (Industrial Electronics Association of Germany) fines of upwards of EUR 10,000.00 will be imposed in the case of infringements. Such fines would be accompanied by an obligatory market ban (confiscation) to say nothing of proceedings under competition law.
